Types of social support for citizens. Social support for certain categories of citizens


Federal Law No. 122-FZ of August 22, 2004 established that when replacing benefits in kind with cash compensation, subjects of the Russian Federation and municipalities must comply with the following principles:

  • ensure the preservation and possible increase the previously achieved level of social protection of citizens, taking into account the specifics of their legal, property status, as well as other circumstances;
  • maintain the stability of legal regulation in order to maintain the confidence of citizens in the law and the actions of the state;
  • provide citizens with the opportunity to adapt to changes within a reasonable transition period through the establishment of temporary regulation public relations;
  • prevent violation of the rights and freedoms of third parties in the exercise by citizens of social rights and freedoms.

To measures of social support certain categories citizens include:

  • monthly cash payment;
  • providing social services without payment or on preferential terms.

2) labor veterans and persons equated to them as of December 31, 2004, namely:

  • awarded orders or medals, or awarded honorary titles of the USSR or the Russian Federation, or awarded departmental insignia in labor and having the length of service necessary for the appointment of an old-age or long service pension;

3) rehabilitated persons, which include:

  • subjected to repression in the form of imprisonment, exile, expulsion, sending to a special settlement, forced labor under conditions of restriction of freedom, including in the "work columns of the NKVD", other restrictions on rights and freedoms, unreasonably placed in psychiatric hospitals and subsequently rehabilitated;
  • children who were together with parents repressed for political reasons or persons who replaced them, in places of deprivation of liberty, in exile, exile, in a special settlement, or who remained at a minor age without the care of parents or one of them, unreasonably repressed for political reasons, and subsequently rehabilitated;

4) citizens recognized as victims of political repression - children, spouses (who did not remarry), parents of persons who were shot or died in places of deprivation of liberty and rehabilitated posthumously.

Indexation of the size of the monthly cash payment is made in accordance with the Law of the City of Moscow on the budget of the city of Moscow for the corresponding year. In accordance with the Decree of the Government of Moscow dated March 26, 2007, the amount of the monthly cash payment, taking into account the indexation by 7.5%, from April 1, 2007, was:

  1. to rehabilitated persons and citizens recognized as victims of political repression - 433 rubles. per month;

Citizens who refused to receive city measures of social support in kind received monthly cash payments in the following amounts:

  • 345 rub. per month - instead of free prescription drugs;
  • 175 rub. per month - instead of a 50% discount on the cost of medicines purchased by prescription;
  • 60 rub. per month - instead of preferential travel by suburban rail transport.

The social protection authorities have compiled and maintain a city-wide register of recipients of social support measures. It contains information about citizens permanently residing in Moscow and entitled to receive social support (assistance).

Additional measures of social support for "federal beneficiaries" include:

  • the right to free travel in Moscow on all types of urban passenger transport (except for taxis and fixed-route taxis);
  • the right to free travel by suburban rail transport;
  • 50% discount on payment for housing and communal services in the manner established by the Moscow Government;
  • for subscribers of telephone networks, a monthly cash compensation for paying for local telephone services provided in the territory of Moscow in the amount of 190 rubles. The amount of the specified compensation for subsequent years is determined by the law on the budget of the city of Moscow for the next financial year and (or) other regulatory legal acts of the state authorities of the city of Moscow;
  • free production and repair of dentures (except for the cost of paying the cost of precious metals and cermets), etc.

Social support for persons with special services to the state

The Russian Federation recognizes the special merits to the state of citizens awarded state awards and honorary titles (Heroes of the Soviet Union and Russian Federation, full cavaliers of the Order of Glory, Heroes of Socialist Labor, full cavaliers of the Order of Labor Glory and others). In order to ensure economic and social well-being for them and their families, additional measures of social support have been established.

  • the right to priority care in medical institutions of all types;
  • priority provision of medicines, delivery of medicines to the house upon the conclusion of a doctor;
  • free production and repair of dentures (with the exception of dentures made of precious metals) in medical and preventive institutions of the state and municipal systems health care;
  • priority receipt of sanatorium-resort vouchers once a year;
  • exemption from payment for housing and housing and communal services in houses of any form of ownership;
  • reimbursement of expenses for the use of a home telephone in full;
  • priority improvement of living conditions in the provision of residential premises in the houses of the state and municipal housing stock with the provision of additional living space up to 15 sq.m.;
  • free provision of land plots for individual housing and summer cottage construction, personal subsidiary farm, horticulture and horticulture in the amount established by the Land Code of the Russian Federation, but not less than 0.08 ha in cities and urban-type settlements and 0.25 ha in countryside.

Instead of the above measures of social support, at the request of persons awarded honorary titles, a monthly cash payment (UDV) may be provided. Citizens of the Russian Federation who have repeatedly been awarded these titles are entitled to one monthly cash payment. UDV is indexed in the same order as the BC part of the labor pension.

In the event of the death of a Hero of the Soviet Union or the Russian Federation, a Hero of Socialist Labor, a full cavalier of the Order of Glory or the Order of Labor Glory, his family members have the right to submit to the territorial body of the PFR an application to waive social support measures (benefits) and to choose a monthly cash payment. The amount of the UDV for each member is determined by dividing the amount of the monthly cash payment established for the Heroes of the Soviet Union or the Russian Federation, Heroes of Socialist Labor, full holders of the Order of Glory or the Order of Labor Glory, by the number of members of his family.

c) a certificate from the body that pays the pension at the place of residence or place of stay of the caregiver stating that no pension has been awarded to this person;

d) a certificate from the employment service authority at the place of residence of the caregiver that he has not received unemployment benefits;

e) certificate of disability, or an extract from the certificate of examination in the federal public institution medical and social expertise;

f) a medical report on the recognition of a child under the age of 18 as a disabled person;

g) the conclusion of a medical institution on the need for an elderly citizen in constant outside care.

If such documents are available in the pension file of a disabled citizen, their submission is not required.

The decision on the appointment of a compensation payment is made by the body that pays the pension within 10 days from the date of submission of the application with all necessary documents. Payments are terminated in the following cases:

  • the death of a disabled citizen or a person who provided care, as well as their recognition in the prescribed manner as dead or missing;
  • termination of care;
  • granting a caregiver a pension, regardless of its type and amount, or unemployment benefits;
  • performing paid work by the caregiver;
  • expiration of the period for which the I group of disability or the category "disabled child" was established;
  • achievement by a disabled child of the age of 18 years, if upon reaching this age group I of disability is not established;
  • placement of a disabled citizen in a state or municipal stationary institution social service;
  • deprivation of a parent caring for a disabled child, parental rights.

The caregiver is obliged to notify the body that pays the pension within 5 days of the occurrence of circumstances that lead to the termination of the compensation payment. The payment is terminated from the 1st day of the month following the month in which the listed circumstances occurred.

The amounts of the appointed compensation payment, not received in a timely manner, are paid for the past time, but not more than 3 years.     Social support measures provided by the Pension Fund of the Russian Federation

    As the Constitutional Court of the Russian Federation pointed out, in their constitutional and legal sense, these principles imply the obligation of the Russian Federation to participate in the financing by the constituent entities of the Russian Federation of measures of social support for rehabilitated persons and persons recognized as victims of political repression, at a level not lower than that established in accordance with federal legislation until 01.01.2005 (Determination of the Constitutional Court of the Russian Federation of July 11, 2006 No. 353-O)

    In accordance with Article 2 of the Federal Law of November 24, 1995 No. 181-FZ “On the Social Protection of the Disabled in the Russian Federation”, social support refers to a system of measures that ensures social guarantees disabled people, with the exception of pensions.     Modern system social support measures apply to certain categories of citizens and include the following types (Appendix. Fig. 43, 44.):

    Monthly cash payment;

    Other cash payments;

    Full or partial exemption from payment of utility and other services;

    Set of social services.

    Social support measures are provided without taking into account the financial situation of persons entitled to them.

    2. Monthly cash payment

    The following categories of “federal beneficiaries” are entitled to a monthly cash payment:

    1) war invalids;

    2) participants in the Great Patriotic War;

    3) combat veterans;

    4) military personnel who served in military units, institutions, military educational institutions that were not part of the army in the period from 06/22/1941 to 09/03/1945 for at least six months, military personnel awarded orders or medals USSR for service in the specified period;

    5) persons awarded with the badge "Inhabitant of besieged Leningrad";

    6) persons who worked during the Great Patriotic War at air defense facilities, the construction of defensive structures, naval bases, airfields and other military facilities within the rear borders of active fronts, operating zones of active fleets, on front-line sections of railways and roads, and also members of the crews of ships of the transport fleet, interned at the beginning of the Great Patriotic War in the ports of other states;

    7) family members of the fallen (deceased) disabled war veterans, participants of the Great Patriotic War and veterans of hostilities, family members of the persons who died in the Great Patriotic War from among the personnel of the self-defense groups of the facility and emergency teams of the local air defense, as well as family members of the deceased hospital workers and hospitals in Leningrad.

    If a citizen is simultaneously entitled to receive a monthly cash payment for several reasons, then one is assigned - a higher one in size.

    The monthly payment is set as follows:

    1) war invalids - 2683 rubles;

    2) participants of the Great Patriotic War - 2012 rubles;

    3) veterans of military operations and persons awarded the badge "Inhabitant of besieged Leningrad" - 1476 rubles;

    4) military personnel who served in military units, institutions, military educational institutions that were not part of the army in the period from 06/22/1941 to 09/03/1945 for at least six months, military personnel awarded orders or medals USSR for service in the specified period, and other categories specified in the law - 805 rubles.

    The monthly cash payment is indexed in the manner and within the time limits established by the Federal Law of December 17, 2001 No. 173-FZ “On labor pensions in the Russian Federation” for indexing the size of the BC labor pension.

    Its payment is carried out by the territorial body of the PFR.

    Part of the amount of the monthly cash payment may be used to finance the provision of a set of social services in accordance with the Federal Law of July 17, 1999 No. 178-FZ "On State Social Assistance".

    March 25, 2019 , The government submitted to the State Duma a draft law on changing the procedure for calculating pensions for military pensioners - participants in the Great Patriotic War Order dated March 25, 2019 No. 511-r. Taking into account the implementation by the Government of Russia in the period from January 1, 2012 to January 1, 2019 of the Decree of the President of Russia of May 7, 2012 No. 604 "On the further improvement of military service in the Russian Federation" in terms of the annual increase in pensions for citizens dismissed from military service, no less than 2% above the inflation rate, as of January 1, 2019, for all categories of military pensioners, including those who are veterans of the Great Patriotic War, military pensions are calculated based on the share of monetary allowance in the amount of 72.23%. The bill proposes to calculate pensions for military pensioners - participants in the Great Patriotic War based on 100% of the monetary allowance taken into account when calculating pensions.
