International license. Documents and permits required for admission to international road transport


Permission to international shipping cargo is called admission to the implementation of these transportations (MAP approval). Read about the procedure and conditions for obtaining it, the validity period in this article.

Conditions for obtaining a permit for international transportation of goods for individual entrepreneurs and organizations

International road transport of goods is:

  • transit;
  • bilateral;
  • from or to the territory of a third State.

The criteria for attributing transportation to each of the types are approved by order of the Ministry of Transport of Russia dated August 19, 2015 No. 248.

To conduct this activity, a Russian carrier, regardless of type, needs to obtain a permit for international transportation of goods by road - the so-called MAP permit.

According to paragraph 3 of the provision, approved. Government Decree No. 730 dated October 16, 2001 (hereinafter referred to as Regulation No. 730), the conditions for issuing a permit for international transportation of goods for individual entrepreneurs and legal entities include:

  • compliance of the vehicle (TC) with international technical standards;
  • availability of appropriate qualifications for drivers;
  • sustainable financial position carrier applicant;
  • the presence of a valid OSAGO policy.

Compliance with these conditions is confirmed by documents, copies of which must be submitted along with the application.

The procedure for obtaining admission to international transportation

Documents for obtaining a MAP permit are submitted to structural subdivision Rostransnadzor is an interregional department of Gosavtodornadzor.

The list of documents to be submitted is contained in clause 7 of regulation No. 730.

  1. Application containing information:
  • about the applicant: name of the organization / full name and passport details of the entrepreneur, address, TIN, entry number in the EGRIP / USRLE;

  • the driver who will drive this vehicle;
  • period for which permission is requested.

  2. A copy of the document confirming the qualification of the driver.
  3. Documents confirming financial stability applicant: balance sheet and statement of financial results. Instead of accounting, you can provide information on the cadastral value of real estate if the carrier has real estate worth more than 300 thousand rubles.

Gosavtodornadzor considers the documents within 30 days from the date of their receipt.

If the state body has made a positive decision, it issues a certificate and an admission card to the applicant.

Identity card and admission card - what's the difference

The carrier is issued:

  • certificate of admission, confirming his right to international transportation by road;
  • admission card for the vehicle on which transportation will be carried out (clause 6 of regulation No. 730).

The forms of these documents are approved by the Ministry of Transport of the Russian Federation, they are documents of strict accountability.

Information about issued certificates and access cards is entered in a special register. It can be downloaded from the Rostransnadzor website.

The certificate is issued in the following order.

  1. At the first application to Gosavtodornadzor, the validity of the certificate is set to 1 year. It cannot be renewed, you need to apply for a new certificate.
  2. The second time the certificate is issued for the period specified in the application, but not more than 5 years.

This certificate can be renewed - an application for renewal is submitted 30 days before the expiration date. Gosavtodornadzor can satisfy an application for an extension 2 times, then you will have to issue a new one.

There may be a situation when the carrier has acquired another vehicle, increased its fleet. Then he needs to get access cards for new vehicles. To do this, they submit an application to the supervisory authority, which indicates:

  • certificate number;
  • information about the new vehicle.

The certificate and access card are issued free of charge.

NOTE! It is possible to submit an application for issuance of a MAP permit, renewal of a certificate and permit cards not only in writing, but also electronically (clause 22 (1) of Regulation No. 730).

Rights, obligations, liability of a carrier with MAP approval

We will briefly describe the rights, duties and responsibilities of a carrier with MAP approval.

A carrier holding this type of permit is entitled to obtain a permit from a foreign state power for travel through the territory of this foreign state, as well as for registration of transportation using a TIR carnet.

The duties of the carrier include (clause 16 of regulation No. 730):

  • compliance with the legislation of the Russian Federation and international treaties;
  • control of the period of validity of access cards and whether the driver has a certificate of the appropriate level of competence;
  • timely warning of Gosavtodornadzor about planned changes in constituent documents, etc.

For the implementation of transportation in the absence of permission from the MAP, the driver may be held liable under Art. 11.29 Administrative Code.

How to get permission for the international transport of dangerous goods

The permit for the international carriage of goods by road, discussed above, must be obtained in any case. Without it, the carrier is not allowed to international cargo transportation (clause 7, article 2 of the law "On State ..." dated July 24, 1998 No. 127-FZ).

If the cargo being transported is dangerous, you must also obtain a special permit for international transport. dangerous goods. This is an independent document, it is issued after obtaining the approval of the MAP.

At the same time, the following are submitted to Gosavtodornadzor:

  • statement;
  • a copy of the certificate of approval of the vehicle for the carriage of dangerous goods;
  • a copy of the vehicle passport;
  • a copy of the developed route for the transportation of dangerous goods, etc.

To conduct international road transport activities, a license is not needed, it is necessary to obtain an MAP permit. It includes an identity card and an access card. These documents are issued free of charge in Gosavtodornadzor within 30 days from the date of application. If the cargo is dangerous or very heavy, in addition to the MAP approval, you must also obtain a special permit for the transportation of such cargo.

What documents are needed to obtain a license

To obtain a permit for cargo transportation, you need to provide notarized photocopies of:

  • passports for existing vehicles;
  • inspection certificates;
  • lease agreements in the presence of rented vehicles;
  • insurance certificate;
  • certificate of registration of the enterprise, certified by a notary;
  • constituent documents;
  • codes entrepreneurial activity;
  • details of the enterprise: addresses of the actual location, telephones, full name transport drivers;
  • certificate of the agreement for the storage of transport in a documented place in the presence of its own parking lot;
  • the composition of specialists, the data of the order on their appointment to the position of a driver, information on professional suitability, the presence of traffic safety diplomas;
  • medical examination data for each driver.

Who issues permits

Admission - a permit for international transportation and cargo, issued by the Transport Authority, which is subordinate to Rosmintrans. A completed application must be attached to the documents, and the state duty must be paid. The total amount of expenses, taking into account notary expenses, will be 6000-6500 rubles. Transportation licensing is issued to companies for 1 year, to organizations that have previously received this permit - for 5 years. A transport permit is issued for each vehicle in the form of a certificate. Each driver must carefully store the document, keep it constantly in the cab of his car. After the expiration of the specified period, you can submit a new application for renewal and renewal of the license, but not earlier than 3-6 months before the expiration date of the current application. The license cannot be renewed more than 2 times.

Carrying out international transportation activities without a license is illegal, fines are imposed on entrepreneurs, problems may arise when obtaining admission in the future. It is recommended that individual entrepreneurs prepare and submit relevant paperwork to the transport inspectorate immediately after registering their business activities. Who can be denied a license

An application for a transportation license may be rejected due to:

  • inaccurate, false information in the submitted documents;
  • non-fulfillment of the instructions indicated by law;
  • the enterprise is on the verge of liquidation;
  • loss by drivers of qualifications, deprivation of their driver's license;
  • received information from other public services about non-fulfillment of certain requirements.

In case of refusal, the Licensing Committee must notify the applicant in writing, indicate the reason for the negative verdict. If you have received the necessary document for the transportation of international goods, then entrepreneurs are obliged to comply with all the conditions prescribed in it, take care of the document, and not transfer it to third parties. Otherwise, the license may be revoked, the work of the entrepreneur is suspended, and all participants are prosecuted.

Admission to international road transport

In order to provide non-tariff regulation methods for conducting a unified state foreign trade policy in the field of international road transport, protecting the economic interests of the Russian Federation, creating conditions for the effective integration of Russian carriers into the world market of transport services and determining the procedure for admitting Russian carriers to international road transport "Regulations on the admission of Russian carriers to international road transport", approved by the Decree of the Government of the Russian Federation of October 16, 2001 No. 730.

Legal entities are allowed to international road transport, regardless of organizational - legal form and individual entrepreneurs commercial And non-commercial transportation of goods and passengers.

Non-commercial transportation is understood as the transportation by Russian carriers of their goods at their own expense for production needs or their employees (on buses with a capacity of more than 9 person, including the driver) on vehicles owned by them on the right of ownership or on other legal grounds.

The admission of a Russian carrier to international road transport federal Service on supervision in the field of transport, as well as its territorial bodies. In the Tver region, admission to international road transport is carried out by UGADN in the Tver region.

The conditions for the admission of a Russian carrier to international road transport are:

Availability of vehicles that are owned or otherwise legally owned and comply with international technical standards, and international conventions and agreements governing international road transport;

Compliance of the persons appointed by the Russian carrier responsible for the implementation of international road transport, qualification requirements on the organization of transportation by road in international traffic;

A stable financial position of a Russian carrier (ownership of property worth at least 300 thousand rubles when using only one vehicle engaged in international road transport, and at least 170 thousand rubles for each additional vehicle);

Compulsory insurance of civil liability of motor vehicle owners.

The decision on the admission of a Russian carrier to international road transport is taken by the authorized body within 30 days from the date of receipt of the application.

In confirmation of the decision on the admission of a Russian carrier to international road transport, he is issued admission certificate, and admission card for each vehicle on which international road transport will be carried out.

To obtain admission to international road transport, a Russian carrier submits authorized body at the place of registration the following documents:

1. An application specifying:

For legal entity - name and location of the applicant, an identification number taxpayer and the main state registration number of the record of state registration legal entity in the Unified state register legal entities;

For individual entrepreneur - last name, first name, patronymic, place of residence, details of an identity document, taxpayer identification number and the main state registration number of the entry on state registration of an individual entrepreneur;

Information about vehicles (type, make and model of the vehicle, state registration plate of the car, trailer and semi-trailer, date of manufacture of the vehicle);

Information about responsible specialists (last name, first name and patronymic, position held);

The period for which the permit is issued;

2. Copies of the following documents:

Documents confirming the availability on the right of ownership or other legal basis of the vehicles intended for use and their state registration;

Compulsory civil liability insurance policy for vehicle owners;

Documents confirming the professional competence of the responsible specialist.

The certificate is issued:

On 1 a year - for Russian carriers who filed an application for the first time;

On 5 years (unless a shorter period is indicated in the application) - to Russian carriers who have submitted an application for a new certificate after the expiration of the previously issued certificate.

The validity period of the certificate issued for 5 years, may be extended at the request of its owner, but no more 2 once. The validity period of the certificate issued for 1 year, not renewable. The renewal of the certificate is carried out within 30 days from the date of receipt of the relevant application of the Russian carrier.

When increasing the fleet of vehicles, the owner of the certificate can receive an admission card for each newly acquired vehicle from the transport control and supervision authority.

To obtain an access card, a Russian carrier submits the following documents to the transport control and supervision authority at the place of registration:

Application for the issuance of an admission card indicating the number of the certificate;

Documents confirming the availability on the right of ownership or other legal basis of the newly acquired vehicles intended for use and their state registration;

Compulsory third party liability insurance policy for vehicle owners for each newly purchased vehicle intended for use.

The certificate is the basis for issuing a permit to a Russian carrier from the competent authority of a foreign state for the passage of specific vehicles through the territory of this foreign state, as well as one of the mandatory documents for admission to the international road transport procedure in accordance with the Customs Convention on the international carriage of goods using a TIR carnet ( 1975).

Consideration of an application for admission to international road transport, issuance, extension and re-issuance of a certificate and admission cards are carried out free of charge.

If the responsible specialist ceased to perform his functions, the holder of the certificate has the right to continue international road transport, provided that within 30 days, documents will be sent to the authorized body for another responsible specialist who has the necessary qualifications and who is responsible for the performance of these functions.

The issuance or renewal of a certificate may be refused in the following cases:

The presence in the documents submitted by the Russian carrier of inaccurate or distorted information;

Non-compliance of the Russian carrier with the conditions of admission to international road transport;

Cancellation of a certificate from which less than 1 of the year.

The owner of the certificate must:

Comply with the legislation of the Russian Federation, the requirements of international treaties of the Russian Federation and the Regulations;

Ensure that the driver of the vehicle has an access card for international road transport;

In case of transformation of a legal entity, change of its name or location, or change of name or place of residence of an individual entrepreneur, no later than 15 days to submit an application for reissuing the certificate and access cards with the attachment of documents confirming these changes. Prior to the reissuance of these documents, international road transport may be carried out on the basis of previously issued documents, on which the transport control and supervision authority marks the acceptance of an application for their reissuance;

In case of suspension of the validity of the certificate or its cancellation, return the certificate and access cards to the authorized body.

Transfer of the certificate to another Russian carrier, as well as access cards for the use of a vehicle that does not belong to the owner of the specified certificate or transferred by him into the possession of another person, prohibited.

UGADN in the Tver region, within the limits of its authority, exercises state control over compliance by the holders of certificates with the requirements of the legislation of the Russian Federation, international treaties of the Russian Federation and the Regulations. In case of detection of violations by the owner of the certificate of the requirements of the legislation of the Russian Federation, international treaties of the Russian Federation and the Regulations, the Department has the right to:

issue warnings;

Suspend the certificate for a period not exceeding 6 months;

Cancel certificate.

The holder of the certificate must notify writing the authorized body to eliminate the violations that led to the suspension of the certificate. After receiving the relevant notification, the authorized body, if necessary, checks the elimination by the owner of the certificate of the violations that led to the suspension of the validity of the certificate, decides on the renewal of its validity and the return of the certificate and access cards and notifies the owner of the certificate in writing within 7 days.

The period of validity of the certificate for the period of its suspension is not extended.

If the owner of the certificate does not eliminate the identified violations within the prescribed period, the certificate is canceled.

The decision to issue a warning, suspend or revoke a certificate may also be made on the basis of information customs authorities of the Russian Federation or the competent authority of a foreign state, respectively, about a violation by the owner of the certificate customs regulations or the tax legislation of the Russian Federation or the procedure for performing international road transport on the territory of a foreign state.

Submission of applications for the issuance of a permit for a Russian carrier to carry out international road transport, extension of the validity period of the certificate and access cards for a vehicle on which international road transport will be carried out, reissuance of the certificate and documents attached to them, as well as notification of the elimination of violations that resulted in is the suspension of the validity of the certificate, is carried out by the applicant in writing, including through postal item, or in electronic form using electronic signature in the manner established by the Government of the Russian Federation, using the federal state information system"Single portal of state and municipal services(functions)".

The applicant receives information about the course of consideration of these applications and notifications in writing, including by mail, and in the case of submission of such documents in electronic form - using the federal state information system "Unified portal of state and municipal services (functions)".

The issuance of a certificate and (or) access cards is carried out upon personal application of the applicant to the transport control and supervision authority at the place of its registration, and in the case of filing an application in electronic form using the federal state information system "Unified portal of state and municipal services (functions)" - also with the submission of copies of documents sent electronically.
